May 29, 2009: Take You Down by Jeffrey Cottrill Things are going to heat up next month in the case against recording artist Chris Brown. His ex-girlfriend Rihanna, who charged Brown with felony assault and making criminal threats in March, is going to take the stand against him in a June 22 preliminary hearing in Los Angeles. "The judge advised me that there will be a subpoena for Rihanna as a witness at the preliminary hearing. She will definitely comply," Rihanna's lawyer, Donald Etra, told E! News on May 28. Brown, 20, was charged after a February argument with Rihanna in a rented car, just before the couple was to appear at the Grammy Awards. The argument allegedly left her with numerous physical injuries; Brown is suspected of hitting and choking her. If the case goes to trial, the "With You" and "Forever" singer-rapper could face up to five years in prison.
This will be the first time Rihanna, 21, appears in court against Brown. Meanwhile, Judge Patricia Schnegg has thrown out a motion from Brown's attorney, Mark Geragos, to commission police records regarding a publicized photo of a bruised, beaten Rihanna that TMZ.com made public. While Geragos says that the Los Angeles Police Department illegally leaked the photo to the celebrity-gossip website, Judge Schnegg countered that this did not affect how the officers handled the case. She added that the motion was premature and "a fishing expedition", The Associated Press reports. "The allegation," Judge Schnegg said in Los Angeles Superior Court on May 28, according to E! Online, "is that some civilian or officer got the photo to TMZ. Did it [have an] impact [on] the arrest of your client on that date? I think not." Geragos still plans to file a motion to dismiss the charges after the preliminary hearing. He says that he needs access to the police records for the cross-examination of the LAPD witnesses. Chris Brown released his self-titled debut album at the age of 16. His other hits include "Run It!" and "Kiss Kiss", and his third album, Graffiti, is set for release this summer. He has also acted in the movies Stomp the Yard and This Christmas. Fellow R&B singer Rihanna, whose real name is Robyn Rihanna Fenty, grew up in the and moved to the in 2005. Her hit singles include "SOS", "Umbrella", "Don't Stop the Music", and "Take a Bow".
