Long story shor. We live in Michigan. My husband and his ex divorced in 1995. They owned a house and 20-acres. She got the house and 3-acres - he got 17 acres. In the divorce agreement, and subsequently the judgment, she added a clause that states that he cannot build on his 17-acres without her written permission.
We were told by one Michigan attorney recently that the statute of limitations on their divorce judgment has long since expired and that she could not enforce the provision now (it is 16 years later). A pole barn sits on the 17 acres and we would like to add on to it, or build another barn there. Just want to make sure we won't have to tear it down! You must Login / Register to post a reply.
