So my husband and I are getting divorced but I promised I would wait until he got his citizenship status approved he's we will have been married for 5 years Dec 14th this year, problem is we have a court case regarding a DUi of his from years ago which is on Dec 21st. Will filing a dissolution before our 5 year anniversary cause him problems and also will it be to late I read as long as you file before 5 years you should be okay but I wanted to be sure. If we file end of November I really want to know if the courts would also see this and if it would in fact cause problems with him as he has a daughter from a previous relationship I do not want him to be deported we are also still friends but I want out so I can move on as well.
