My daughter had her baby in prison. Listed me as the authorized person to pick up baby, which I guess gave me Guardianship of the little girl. I have a notarized paper stating this. Question is, she is still married to the father and at the time, were still together. Have since separated and she is going to file for divorce. What rights does he have and do I have with regards to this child.

Also, any advice in regards to divorce and her rights for these children. She gets out in July, should she wait to file? The father is also on parole and has been caught with meth twice and we are concerned for the children, they have 3.
