A child can choose which parent to live with at age 18. Prior to that time, a court may take a child's wishes into account, but the younger the child, the less the court will give weight to those wishes. The age that a court will start to listen to a child varies by state, but usually it is not until the child is about 14 that their wishes will matter.
That being said, if there is a custody schedule in place under which your daughter is supposed to be spending certain overnights with her father, she has to go and you have to encourage her going. | |
