Married 2 years, 9 months.
No children. My wife is a nurse and has been employed throughout the marriage. Earns about 3100/month. She was making about 3400/mo but decided to take a lower paying job after our separation. I earn about 3600/mo and had been earning about 3850/mo but took my current job before our separation. Wife's lawyer sent me a calculation of spousal support based on my previous job bonus + salary and using wife's current salary. Is this fair? What is the likelihood the judge will grant spousal support? If so, what is maximum length and amount of support? If the request is denied, can I seek legal fees for my defense in this case? Thanks! @Distraught
It would depend on the state you live in but in my state - PA. Cohabitation will bar a spouse from seeking spousal support. My spousal support case would only go in front of a judge if we couldn't agree on the amount and then it's really up in the air. But you will have to prove cohabitation. Good luck |

new to the forum. I was hoping to see responses on this. my wife is asking for support as well. granted I make more money than her, I also pay all the bills which at the end of the month she has more money. she isnt with me in the family home and lives with a new person. most recently, she has decided to seek spousal support so she can quit her job and go to school. my question would be can she do that and make me pay for her education even though she is with another under his roof? I'll be watching this thread. hope you get your answer. I am told from my lawyer that these letters from the other side arent even typically seen by the judge and they are used to intimidate the other party.
