(Canada Question): My 17 year old daughter has lived with me for the past year with no financial support from her father (his income is twice that of mine). I paid her father child support for 9 years, according to the court order, for my son and daughter. My son has worked full-time for 7 months while living with his father. My son is soon off to college and is demanding that I pay tuition, residence, books and supplies, and a meal plan, even though he never comes to visit with me, I have never even received a mother’s day card, birthday card, Christmas card etc. My intention has always been to help him with tuition but isn’t residence, meal plans, and other living expenses considered support? Now that I fully support my daughter must I also continue to pay my son and his father child support for residence and meals?

I believe that it depends on what area that you live in. In California where I am, court rulings can even differ between counties.
Other factors would include income amounts, how old the college-aged child is, what type of emotional bond you share, how well-equipped each parent is to care for the child/ren, whether or not a court agreement is open to modification years later...etc. Try to find a free consultation with an attorney. Those can really help figure out what can be done, and are usually obligation-free. Also, get verifiable documentation for any claims you need to make. Good luck! Sorry I couldn't offer more detailed advice. | |
