Title: Lying about his income because he gets cash
My ex-husband was earning $65k+ 6 years ago prior to our separation. The last 3 years he is reporting an income of $45k, yet working for the same employer (very small company, he knows the owner). I am certain he is receiving a large amount of his income through cash. He has not earned such a low amount in over 12 years.

He also has a higher standard of living than me, with travel, purchases, etc.. I am currently unemployed, collecting UI and only $800 from him for 2 children.

Can i go to court and request more money based on the fact i strongly believe he is earning cash... or can i request more money based on our standard of living comparison? he has remarried and has a household income in excess of $100k, my income is only UI, a fraction of it.

What is the best route for me to take, to hopefully get an increase ASAP because i can not afford my bills.

(we have joint custody with children 65% me and 35% him)

The remarriage and increased household income is irrelevant. Surely you are not expecting his new wife to pay for raising your children?

The standard of living argument isn't going to get too far either. For all you know, he is running up huge amounts of debt to support his spending habits.

As for his decreased income, it is possible he is getting paid under the table. It is also possible that he has had to take a pay cut due to the economy. If you really want to pursue this, you will need to hire a lawyer and a forensic accountant to comb through his financial records to see if they can show that he is getting paid cash.
