Title: Alimony & Support
Agreed to 5 yrs of alimony/maintenance at the time of the divorce settlement after 26 yrs of marriage. 5 yrs has just recently passed, do I have any recourse at this point to take ex back to court for a review of maintenance even though that date has passed?

What have you done in the 5 years to become self supporting?

In many states the alimony is modifiable. Especially if there is a change in circumstances.

It might seem unfair but we don't know all of the circumstances. Gabriel was asking if she had any recourse. She might have. I lawyer would be be able to advise her on her legal rights.

Alfie -

You may be right (that 5 years of alimony for a 26 year marriage is somewhat short), but that is an issue that should have been addressed at the time of divorce, not after the original term of support has run out. For all we know, her ex paid a huge amount of support for five years in order to avoid paying a smaller amount for a longer period. For her to be able to go back in now and get the alimony extended would be grossly unfair to her former husband.

5 years of support doesn't sound much after 26 years of marriage. Check with a lawyer. Every case is different.

No, you do not. You agreed to five years, the five years is up, end of story.
