The next showdown between Texans who support gay divorce and those who oppose it may be before the state's Supreme Court. 

That's because a Dallas gay couple, whose divorce was denied by the Texas Court of Appeals in August of last year -- after initially being allowed in October, 2009 by a Dallas County District Judge -- have decided to take their case to the state's highest court.

"We respectfully disagree fundamentally with the Court of Appeals ruling that denies equal access to divorce,” stated the firm retained to appeal the ruling. "Thus we’ve decided to request that the Texas Supreme Court review the case.”

It's unclear whether the Texas Supreme Court, which is considered conservative, will agree to hear the appeal. However, the divorce lawyer for one of the gay spouses remains optimistic. “In my business, you always believe that justice can prevail, and the justices on our Supreme Court, just like every other judge and lawyer, are bound to apply the law equally to everybody,” the attorney shared with DallasVoice.com. “I know people are cynical about that, but that’s actually the way our system works.”
